12. Payments and Payment Gateway

We offer various payment modes for your convenience and use HitPay Payment Solutions Pte Ltd ("HitPay"), a licensed Major Payment Institution (PS20200643) under Singapore's Payment Services Act, as our payment gateway provider for Domestic Money Transfer Services, Cross-Border Money Transfer Services, and Merchant Acquisition Services. HitPay's registered address is 1 Keong Saik Road, Singapore 089109.

Payment Gateway Liability: Airple Construction Pte Ltd is not liable for any technical failures, service interruptions, or loss of funds resulting from the use of HitPay. In the event of such occurrences, Airple will assist affected users by providing necessary documentation and information to the best of our ability.

13. Limitation of Liability

To the fullest extent permitted by applicable law, Airple Construction Pte Ltd will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use our Services.
• Any unauthorized access to or use of our servers and/or any personal information stored therein.
• Any bugs, viruses, Trojan horses, or the like that may be transmitted to or through our Services by any third party.
• Any errors or inaccuracies in the content of our Services.

17. Priority Booking

Priority Booking Service:

Priority Booking is a service that allows customers to access additional appointment slots, even when standard slots are fully booked. This service is designed to cater to customers who have urgent needs due to circumstances such as extreme heat and humidity.

The Priority Booking feature can be activated via a toggle button in the App, allowing users to select from previously unavailable slots, which are marked in a golden-orange color.

An additional fee of $8 will be added to the cart when a priority slot is selected.

Airple Construction Pte Ltd guarantees that within one hour of checking out with a priority slot, our support center will arrange to fulfill the booking.

18. Refund Policy

Refund Terms and Conditions:

In the event that Airple Construction Pte Ltd fails to activate a team to fulfill a Priority Booking or does not respond within one hour of checkout, the $8 Priority Booking fee will be refunded via the same payment method used by the customer.

Airple Construction Pte Ltd will not be liable to refund charges for any services booked in conjunction with the Priority Booking. Customers can choose to reschedule these services for a different date and time.

Any refunds issued by Airple Construction Pte Ltd as a gesture of goodwill are at the sole discretion of the company. Refunds may be provided as credits to the user's account for future use.

Credits issued to a user's account do not have an expiration date and can be used to offset future bills for any services provided by Airple Construction Pte Ltd.

19. Feedback and Reviews

By submitting feedback or reviews about our Services, you grant Airple Construction Pte Ltd a non-exclusive, perpetual, royalty-free, worldwide license to use, reproduce, modify, publish, and distribute such feedback and reviews for any purpose, including marketing and promotional activities. You acknowledge that Airple Construction Pte Ltd may choose to use your feedback and reviews at its discretion without any obligation to compensate you.

20. Force Majeure

Airple Construction Pte Ltd will not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to acts of God, war, strikes, lockouts, labor disputes, natural disasters, pandemics, governmental regulations, or any other events beyond our control.

21. Governing Law

These Terms and any disputes arising out of or related to these Terms or our Services will be governed by the laws of Singapore, without regard to its conflict of law principles.

22. Dispute Resolution

Any disputes arising out of or in connection with these Terms or our Services shall be referred to and finally resolved by arbitration in Singapore in accordance with the Arbitration Rules of the Singapore International Arbitration Centre for the time being in force.

23. Termination

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms.

24. Additional Mobile Application Features and Notifications

Our App includes additional features that require users to enable notifications. By using these features, you agree to receive notifications from us. These features include:

Technicians Location Live-Feed Tracking: Allows you to view the live location of our technicians before they reach your location for appointments, so you know exactly when they will arrive.

Scheduled and Predictive Schedule Reminders: Provides reminders and notifications for scheduled and predictive maintenance.

Predictive Aircon Health Monitoring: Monitors the health of your air conditioning units and notifies you of any potential issues.

Chat Notifications: Keeps you updated on communications with our support and service teams.

Service Progress Live-Feed: Provides real-time updates on the progress of ongoing services.

Personalized Assistance: Helps to rearrange last-minute changes in appointments both ways in the event of unforeseen circumstances.

These features are developed and provided based on our current knowledge and capabilities, and we are continually working to improve them. However, we do not accept liability for any issues arising from the use of these additional features.

All images and Videos displayed on our website and mobile application are for illustration purposes only and may not represent the actual service or product provided. The actual service or product may vary based on individual circumstances, and Airple Construction Pte Ltd does not guarantee that the images video shown will exactly match the final result.
